Terms and Conditions for the Hello Yellow Marks & Spencer Planters 2026 Free Prize Draw ("Prize Draw") 

1. By entering the prize draw you agree to these prize draw terms and conditions.
2. The promoter of this prize draw is Young Minds Trust, registered charity number 1016968 and company number 02780643 of 4th Floor India House, Curlew Street, London, England, SE1 2ND (the “Charity”).
3. The prize is a Planter provided by Marks & Spencer PLC (company number 00214436) (the “Prize Provider”), the headline partner of Hello Yellow. The prize is subject to availability and any reasonable delivery or installation requirements notified by the Prize Provider or its fulfilment partner.
4. The prize draw is free to enter, and no purchase is necessary.
5. Participants will be entered into the free Prize Draw if:
   1. They are a UK-based education setting
   2. They sign up to Hello Yellow 2026 through the Hello Yellow Schools registration form and opt in to the prize draw
   3. They click the enter button via email to be opted into the prize draw. Upon successful entry, participants will be directed to a confirmation page acknowledging their entry into the prize draw
6. There is a limit of 1 entry per email address.
7. Entrants must provide complete and accurate contact and delivery information when entering the Prize Draw. The Charity and the Prize Provider will not be responsible if a prize cannot be delivered because the information provided is incomplete, inaccurate, or out of date.
8. The closing date of the Prize Draw is 11.59pm (BST, UK) on 8th October 2026. Sign-ups submitted after this date will not be included.
9. The Charity accepts no responsibility for entries not successfully completed due to technical faults, technical malfunction, computer hardware or software failure, network or server failure of any kind.
10. 120 winners will be chosen by random draw from all entrants in the Prize Draw, supervised by an independent person, on 15th October 2026. The independent person must not be directly involved in the management or administration of the prize draw and should be impartial to the outcome, such as an external auditor, a legal representative, or a senior staff member from another department within YoungMinds who is not associated with the prize draw.
11. The prize must be used at the entrant’s school and cannot be used for private use by the winner.
12. There is a limit of 1 prize per education setting, regardless of whether multiple entries are made using different email addresses at the same education setting. If more than one entry from the same education setting is drawn as a winner, only the first valid drawn entry from that education setting will be awarded a prize and any later drawn entries from that education setting will be disregarded.
13. The winners will be notified by email by YoungMinds. Where they are not the main contact at their school to organise delivery, winners must have provided the contact details of the person responsible for this at their school during registration, so this person can be contacted by the Prize Provider’s fulfilment partner. Details of the winners (or main contacts where this differs from the winners) will be provided to the Prize Provider’s fulfilment partner to deliver the prizes. When completing the entry form, the winners must have provided a valid UK education setting postal address, which includes a valid postcode (“Valid Postal Address”) to claim their prize.
14. If a winner or main contact does not respond to the Prize Provider's fulfilment partner within 28 days of being notified to confirm acceptance of the prize, the winner’s prize may be forfeited, and the Charity will be entitled to select another winner in accordance with the process described above. The replacement winner will be subject to the same eligibility, notification, and acceptance requirements.
15. Upon confirmation of acceptance of the prize, the Prize Provider and their supplier will work with the school to arrange a time for delivery of the planter from February 2027 onwards. The Charity is not responsible for the condition of the prize or any delays in its delivery. The Prize Provider assumes full responsibility for the fulfilment and delivery of the prize, including any damage incurred during shipping. Once the prize has been delivered to the specified address, the Prize Provider’s responsibility is fulfilled, and the Charity will not be liable for any subsequent issues with the prize.
16. The prize is non-exchangeable, non-transferable and no cash alternative is offered.
17. The charity reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Charity’s control make it necessary to do so.
18. The decision of the Charity regarding any aspects of the Prize Draw is final and binding, and no correspondence will be entered into about it.
19. The winners’ names can be obtained by sending an email to helloyellow@youngminds.org.uk within 28 days of the closing date of the Prize Draw.
20. The Charity may be required to make available information indicating that a valid award took place, which may include the surname and county of major prize winners, unless a winner objects on legitimate grounds. Winners who object should notify the Charity using the contact details provided in these Terms and Conditions.
21. Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entry. The Charity reserves the right to refuse entry or refuse to award the prize to anyone in breach of these Terms and Conditions.
22. The Charity reserves the right to void, cancel, suspend, or amend these Terms and Conditions where it becomes necessary to do so.
23. Insofar as is permitted by law, the Charity, its agents and distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss or damage occurring as a result of taking up the prize, except where it is caused by the negligence of the Charity, its agents or distributors or that of their employees. Your statutory rights are not affected. For the avoidance of doubt, nothing in these Terms and Conditions shall limit or exclude the Charity’s liability for fraud, personal injury or death, caused by the Charity.
24. The winner may be asked to participate in publicity related to the Prize Draw, which may include the publication of their name and photograph in any media. The winner has the right to choose not to participate in publicity.
25. Personal data supplied during the course of this promotion will be shared with the Prize Provider and its third-party suppliers only where necessary to administer, fulfil, deliver or arrange the prize. The Prize Provider and its suppliers will use that personal data only for those purposes and in accordance with applicable data protection law. 26. Personal details will only be used for marketing purposes if you have consented to receive future marketing from the Charity (you may have already done this if you have registered your details with us previously). Entrants have the right to access, correct, or delete their personal data. 27. The Charity reserves the right to make reasonable changes to these Terms and Conditions from time to time where necessary, including to reflect changes in law, regulation, administration or circumstances beyond the Charity’s control.
28. The Prize Draw, these Terms and Conditions, and any dispute or claim between the parties arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Prize Draw and / or these Terms and Conditions, or their subject matter or formation.
